Terms and Conditions

THE BUYER HAS READ AND UNDERSTANDS THE TERMS AND CONDITIONS CONTAINED WITHIN THIS DOCUMENT, INCLUDING ALL ATTACHMENTS, WHICH ARE INCORPORATED INTO THIS AGREEMENT. By signing a contract with Come To Life Concrete, LL, you are signing a legally binding contract for work to be completed at an agreed-upon price. In the event that you break this contract, all deposits made to the company shall be surrendered as damages.

ONE YEAR – LIMITED WARRANTY:  Come To Life Concrete, LLC warrants major surface water penetration and premature hazing on sealed surfaces for 1 year after service is completed. Items not covered in warranty: damage caused by salt or de-icing products, or structural integrity of the concrete. This warranty covers repairs to the surface sealer, but not replacement or repair of the concrete itself. Come To Life Concrete, LLC offers no warranty for any concrete sealed between October 30th  –  April 15th. If you ever have a concern regarding our work, Come To Life Concrete, LLC should be notified immediately.

Water Usage. By signing this agreement, you agree to provide Come To Life Concrete, LLC the right to use an on-site water supply as needed to complete the stated project without compensation. It is the customer’s responsibility to make sure the water supply is on and in working order before we arrive. Additional charges will be applied if water is not available.

Color and Tone Concerns. The concrete/paver surfaces, species of wood, age and weather can greatly affect the resulting color or tone of the sealer or color. Note: Variances may occur on individual slabs or boards as well as the total project,  as densities and other characteristics vary across the material. Come To Life Concrete, LLC attempts to represent the final finish and color tones as best as possible. While we can often give you an idea of the overall color or tone you must expect some variance in the overall finish.

Courtesy. While Come To Life Concrete, LLC  is on location and performing work on your property, you are responsible for keeping all children and pets, as well as other individuals away from the work area. Children and pets must be kept off the work surface for at least 6 hours after our work is completed. This is for your safety as well as our own.

Cancellation.  This contract may be canceled up to 2 day prior to the date work is scheduled to begin. Deposits are non-refundable for projects canceled less than 2 days prior to the scheduled start of work.

Final Payment and Late Charges.  All balances are due upon completion of the job. Any variance to this policy must be agreed upon and in writing via email. In the event that the Buyer fails to make all final payment(s) within seven (7) days after substantial completion of the Project, Come To Life, LLC may, at its option, increase the contract price by ten percent (10%) to account for Come To Life Concrete, LLC’s additional administrative costs in connection with collection activities. In the event of a breach or default by the Buyer of any payment or other provision of this agreement, the Buyer agrees that he/she shall pay to Come To Life Concrete, LLC all costs of collection, including all reasonable attorneys’ fees, disbursements and expenses incurred by Come To Life Concrete, LLC in an effort to collect payment from the Buyer, whether in litigation, mediation, arbitration or otherwise

Scheduling and Delays. Inclement weather may affect scheduling. We try our best to keep scheduling conflicts to a minimum, however, circumstances that are beyond our control may affect your project start and completion dates. You will be notified of any changes.

Removal & Replacement of Personal Contents. Removal and replacement of grills, deck furniture, planters and any other items are the responsibility of the homeowner. Should we need to remove items from the deck, we will not be responsible for any damage, breakage or for storage issues. An additional charge may be applied for the time and labor devoted to the removal of these items.

Damages. Come To Life Concrete, LLC is not responsible for damages due to improperly installed concrete material, defective construction and improper caulking. Power washing, which entails the removal of chalky, gritty, or failing surface materials may cause the faded aspects of the concrete to stand out. Come To Life Concrete, LLC will not be responsible for such conditions or responsible for loose mortar that may dislodge during the cleaning process.

Stains. Some stains cannot be removed by power washing or cleaners. Tree sap, leaf stains, artillery fungus, splatters from stains and paints are examples of materials that cannot be removed by conventional means. We make every attempt to point these areas out to the customer when quoting the project. Sometimes these stains cannot be removed at all.

Concrete and Hidden Conditions. The appearance of concrete depends on a number of factors most linked to when the concrete was initially poured and cured. For the purpose of this agreement, a hidden condition shall mean a condition not readily observable when inspecting the property for the purpose of estimating and performing the work specified within the context of this Agreement. When concrete with dirt, mold, mildew, algae and other pollutants and stains is cleaned, the concrete will then reveal any and all imperfections that the pollutants and stains have covered up. The customer understands that not all concrete will look the same even on the same driveway, patio, sidewalk, or concrete slab. Come To Life Concrete, LLC will not be responsible for standard white concrete because of color variations. Color variations are considered to be normal and a natural characteristic of concrete or prior sealing.. 

Image Rights.  Come To Life Concrete, LLC reserves the right to take (photo &/or video) images of the project, which may include buyer’s home and landscape, during the project installation &/or at a later date. All images are the sole property of Come To Life Concrete, LLC and may be used in any manner. 

Buyer’s Change Orders.  The Parties to this agreement agree that in the event that there is more than one Buyer listed on this Agreement, the signature of one Buyer will be sufficient to bind all other Buyers to any change orders on the project. All change orders will require a signature by one Buyer and Come To Life Concrete prior to commencement of the change(s).

Overspray.  Concrete sealing process may cause unpreventable overspray. Come To Life Concrete, LLC will use reasonable efforts to reduce application to surfaces other than the concrete, but does not provide covering for property items which includes lawn, vegetation, siding, doors, and other surfaces near the work area. Damage caused by overspray is the responsibility of Buyer.

Injury Warning.  All concrete surfaces may be slippery when wet or covered with snow and ice.  When walking on the concrete, homeowner’s should proceed with caution and inform guests of the same.  If more traction is needed, loose sand is a good option.

Entire Agreement.  This agreement supersedes and terminates all prior contracts, proposals and discussions relating to the proposed work whether expressed or implied in written or in oral form.

THE ABOVE PRICING, SPECIFICATION AND CONDITIONS ARE SATISFACTORY AND ARE HEREBY ACCEPTED BY BUYER.
